Data Protection Information acc. to EU GDPR

In the following text we inform you about the processing of personal data by us. In addition you will receive information about your rights on the grounds of the EU General Data Protection Regulation (GDPR). This information is applicable to all customers of GEO-NET Umweltconsulting GmbH.

Please note: This Data Protection Information is written in the English and German language. The English version shall merely be a non-binding translation of the German version. The German version shall prevail in case of any differences between the English and the German version.

Which data sources do we use?

We process personal data we received from our customers, potential buyers or our business partners.

Furthermore, we may use publicly available sources (e.g. press, media, internet) to collect personal data.

 

Which data will be processed by us?

Generally we process the following data:

  • Name
  • Contact details (address, phone number, email, etc.)
  • Bank details
  • Contract data
  • Tax data
  • Photos / Images in some cases

 

For what purposes do we process the data?

We process the aforementioned personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

Data processing on the grounds of your consent, acc. to art. 6 para. 1 lit. a GDPR

If you have given us your consent to process your personal data for specific purposes (e.g. marketing, data transfer, mailing, newsletters), we will process your data on this legal basis. 

You have the right to withdraw your consent (for the future) at any time. You can also withdraw your consent, if it was given prior to the EU GDPR.

Data processing for the performance of a contract, acc. to art. 6 para. 1 lit. b GDPR

The processing of data may be carried out on the grounds of a contract, or to fulfill a contract (verbally or in writing) you have entered with us. This also includes inquiries prior to entering a contract with us.

Data processing for compliance with a legal obligation, acc. to art. 6 para. 1 lit. c GDPR

The processing of data may be carried out on the grounds of a lawful or legal norm. These may be for example fiscal laws, prevention of money laundering act, or identity or age checks.

Data processing due to legitimate interests pursued by the controller, acc. to art. 6 para. 1 lit. f GDPR

Beyond the aforementioned data processing, we will process personal data to pursue our legitimate interests. These include for example:

  • Marketing
  • Transmission of invitations for events (e.g. fair).
  • Development of products and services
  • Business Management

 

To whom will my data be transferred?

Within our company those persons who require your personal data in order to perform contractual or legal obligations are given access to it.

A transfer of data is carried out in accordance with the EU GDPR, the FDPA and other national or European legal provisions applicable.

Under these conditions, recipients of your personal data may be:

  • Public authorities and institutions
  • Parcel delivery services / transport companies
  • Subcontractors
  • Vicarious agents

 

Is my data transferred to a third country?

Some data processing is carried out in a third country (outside of the EU and the EEA). In these cases the involved companies and institutions are committed by EU standard stipulations to meet data protection requirements according to European laws.

 

For how long will my data be stored?

Your Data will be processed by us, or stored, as long as it is necessary for the performance of our contractual or legal obligations. Afterwards your data is deleted regularly.

Data will not be erased if further processing or storage is necessary for one  of the following reasons:

  • compulsory period of record-keeping prohibits or is opposed to the data erasure;
  • the data has to be preserved as evidence in the context of the statute of limitation;
  • you have given your consent to storing your data for a longer period of time.

 

What are my (data protection) rights?

The data subject – that is the person whose data is processed – has the right to:

  • Access acc. to Art. 15 GDPR
  • Rectification of inaccurate data acc. to Art. 16 GDPR
  • Erasure acc. to Art. 17 GDPR
  • Restriction of Processing acc. to Art. 18 GDPR
  • Data Portability acc. to Art. 20 GDPR
  • Object acc. to Art. 21 GDPR
  • Withdrawal of consent acc. to Art. 7 GDPR
  • Lodge a complaint with a supervisory authority acc. to Art. 77 GDPR

If you have given us your consent to process data, you can withdraw your consent at any time. The withdrawal will only affect any future data processing and cannot be applied to data processing that has already been carried out.

What are my obligations?

To initiate and execute a contractual relationship with us, you have to provide all data that is necessary for the execution and fulfillment of a contract or data that is necessary for the fulfillment of legal requirements.

Without the provision of this data, it is generally not possible to enter into or execute a contract or carry out and existing contract, which in this case might be terminated.

 

Is automated individual decision-making used?

We do not use automated individual decision making.

 

Do you practice profiling?

We do not practice profiling.

 

Right to object to data processing for marketing purposes

You have the right to object the processing of your data for the purpose of direct mail. After your objection we will stop immediately to use your personal data for the purpose of direct mail.
